Terms of Service

Acceptance of Terms

By downloading, installing, or using the PéiNín (陪您) App ("App") provided by Pei Nin Foundation ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms apply to all users of the App, including senior users and their designated family members ("Caregivers") who manage accounts on their behalf.

Description of Service

PéiNín is an AI-powered companion application designed for Chinese-speaking seniors in the United States. The App provides:

• AI voice companionship in Mandarin and Cantonese
• Emergency SOS alerts to designated family members
• GPS location sharing with designated family members
• Daily reminders and wellness check-ins
• Assistance navigating American daily life in Chinese

Important Limitations and Disclaimers

3.2 Not a Medical Device

PéiNín is not a medical device and does not provide medical advice, diagnosis, or treatment. Any health-related conversations with the AI companion are for companionship purposes only and should not replace professional medical advice.

3.3 AI Limitations

The AI companion may not always understand or respond correctly. It may make errors in language, context, or information. Do not rely on the AI for critical decisions involving health, legal matters, or financial matters.

Account Registration and Family Management

Accounts are typically set up and managed by a designated Caregiver (adult child or family member) on behalf of the senior user. The Caregiver is responsible for:

• Providing accurate registration information
• Maintaining the security of account credentials
• Ensuring the senior user understands how to use the App
• Reviewing and agreeing to these Terms on behalf of the senior user

By creating an account, the Caregiver confirms they have authority to act on behalf of the senior user and agrees to these Terms.

Subscription and Payment

PéiNín is offered on a subscription basis with the following tiers:

Subscriptions are billed monthly and automatically renew unless cancelled. You may cancel your subscription at any time through your account settings or by contacting us at info@peininfoundation.org. Cancellations take effect at the end of the current billing period. We do not offer refunds for partial months of service.

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App to harass, abuse, or harm any person
• Attempt to gain unauthorized access to the App or its systems
• Use the App to transmit any harmful, offensive, or illegal content
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use the App for any commercial purpose without our written consent

Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

Intellectual Property

The App and all its content, features, and functionality are owned by Pei Nin Foundation and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the App without our written permission.

Termination

We reserve the right to suspend or terminate your access to the App at any time if you violate these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting us at info@peininfoundation.org.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEI NIN FOUNDATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless Pei Nin Foundation and its officers, directors, and employees from any claims, damages, or expenses (including legal fees) arising from your use of the App or violation of these Terms.

Governing Law

These Terms shall be governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of San Mateo County, California.

Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through a notice in the App. Your continued use of the App after changes take effect constitutes your acceptance of the updated Terms.
